NAC408.321. Compensation for facility taken out of service.

If a utility’s facility is located on a project of the Department, and it is not necessary to adjust or replace the facility on the project because the facility will be taken out of service, any taking of or damage to that facility, including the disposal or removal of that facility from the project, may be compensated with money which is received from the State or Federal Government for the projects and administered by the Department. The loss of the remaining use of the facility or future revenue because of the retirement of the utility’s facility is not compensable.
