NAC439.758. “Hearing officer” defined.

“Hearing officer” means a person who:

1. Did not participate in the decision of the Department that is the subject of the hearing; and

2. Is appointed by the Director of the Department or a designee thereof to preside at a hearing conducted pursuant to NAC 439.779 to 439.787, inclusive.
