“Facility” means all portions of a mining operation, including, but not limited to, the mine, waste rock piles, or piles, beneficiation process components, processed ore disposal sites, and all associated buildings and structures. The term does not include any process component or nonprocess component which is not used for mining or mineral production, and has not been used in the past for mining or mineral production as part of an operation which is active as of September 1, 1989.
