NAC445A.9694. Cluster system.

  •      1. A cluster system may be installed when lot sizes, location or other site conditions make conventional sewage disposal unacceptable and when a local governing agency or its recognized entity, as listed in subsection 1 of NAC 445A.231, assumes responsibility for the operation and maintenance of a cluster system and the obtaining of a permit for the cluster system from the Division or other administrative authority.

         2. A cluster system approved pursuant to this section must obtain an individual permit pursuant to NAC 445A.9602 which must be issued by the Division or other administrative authority to the local governing body or its recognized entity, as listed in subsection 1 of NAC 445A.231, which is responsible for the cluster system.

         3. Cluster systems must be designed and constructed in accordance with the requirements of NAC 445A.950 to 445A.9706, inclusive. A cluster system must be maintained in accordance with the requirements of the individual permit issued for that cluster system.

         4. The tank size of a cluster system must not exceed 25,000 gallons, and the amount of sewage flow from the tank must not exceed the limits of subsection 2 of NAC 445A.9602.
