NAC453A.710. Division authorized to collect fee for costs of investigating complaint if substantiated; amount of fee.

  •      1. The Division may charge and collect a fee from any medical marijuana establishment that is involved in a complaint submitted to the Division by a consumer to recover the costs of investigating the complaint after the investigation is completed if the complaint is substantiated. The fee will be based upon the hourly rate established for each investigator of medical marijuana establishments as determined by the budget of the Division.

         2. As used in this section, “substantiated” means supported or established by evidence or proof.
