  • “Release of a hazardous substance” means the discharge, deposit, injection, dumping, spilling, emitting, leaking, escaping, leaching, pumping, pouring, emptying, disposing or placing of a hazardous substance into the air or on land or the waters of the State. The term does not include a release of a hazardous substance:

         1. Specifically allowed by a permit issued pursuant to state or federal law; or

         2. For which a permit is not required by state or federal law.
