  •      1. Propagating materials from a class of prevariety germplasm that is designated as tested must be the progeny of plants whose parentage has been tested and has proven genetic superiority or possesses distinctive traits for which the heritability is stable, but for which a variety has not been recognized. Prevariety germplasm of the tested class must be produced in a manner that ensures genetic purity and identity from:

         (a) Rigidly controlled and isolated natural stands or individual plants; or

         (b) Seed fields or orchards.

         2. Propagating materials from a class of prevariety germplasm that is designated as selected must be the progeny of phenotypically selected plants of untested parentage that indicate, but do not prove, genetic superiority or distinctive traits. Prevariety germplasm of the selected class must be produced in a manner that ensures genetic purity and identity from:

         (a) Rigidly controlled and isolated natural stands or seed production areas; or

         (b) Seed fields or orchards.

         3. Propagating materials from a class of prevariety germplasm that is designated as source identified must have had no selection or testing of their parent population. Prevariety germplasm of the source identified class must be produced in a manner that ensures genetic purity and identity from:

         (a) Rigidly controlled and isolated natural stands or seed production areas; or

         (b) Seed fields or orchards.
