  •      1. If the Board determines that the conduct of a homeopathic assistant or advanced practitioner of homeopathy raises a reasonable question as to his or her competence to treat a patient with reasonable skill and safety, it will order him or her to undergo a mental or physical examination to test his or her competence and ability to practice as a homeopathic assistant or advanced practitioner.

         2. A person who is certified by the Board to practice as a homeopathic assistant or advanced practitioner shall be deemed to have consented to a mental or physical examination.

         3. A homeopathic assistant or advanced practitioner who refuses to undergo a mental or physical examination shall be deemed to have admitted the charge made against him or her, and the Board will take disciplinary action against such a person without further investigation or testimony.
