STANDARDS OF CONDUCT |
NAC641.206. Authority of parent or legal guardian to make decisions concerning treatment; issues for which child or ward is patient or client.

- If a psychologist, licensed behavior analyst, licensed assistant behavior analyst or certified autism behavior interventionist is treating a child or ward, the parent or legal guardian of the child or ward is the patient or client for the purpose of making decisions concerning treatment. The child or ward who is receiving services from the psychologist, licensed behavior analyst, licensed assistant behavior analyst or certified autism behavior interventionist is also the patient or client for:
1. Issues directly affecting the physical or emotional safety of the child or ward, including, without limitation, sexual relationships or other exploitive dual relationships.
2. Issues which the parent or legal guardian has specifically agreed, before the child or ward receives professional services, must be reserved to the child or ward, including, without limitation, confidential communications between the psychologist, licensed behavior analyst, licensed assistant behavior analyst or certified autism behavior interventionist and the child or ward during the course of the professional relationship.
