NAC319.259. Written request for certification; facilities financed through tax credits relating to low-income housing.

     1. If the sponsor of an assisted living facility that satisfies the requirements of paragraphs (a) to (d), inclusive, of subsection 1 of NRS 319.147 wishes to obtain certification for the assisted living facility from the Division for the purpose of providing services pursuant to the provisions of the home and community-based services waiver which are amended pursuant to NRS 422.2708, the sponsor must submit a written request for certification to the Division.

     2. If the assisted living facility for which a sponsor submits a request for certification pursuant to subsection 1 is financed through tax credits relating to low-income housing, the Division will provide to the Health Division of the Department of Health and Human Services a copy of:

     (a) The written notification of a reservation of tax credits provided by the Division pursuant to NAC 319.978; and

     (b) If the Division granted a request to carry over tax credits pursuant to NAC 319.980, documentation indicating that the Division granted the request.
