  • If a contractor cannot use a portion of the power allocated to it by the Commission in any month, the Commission will, in cooperation with the contractor, endeavor to find markets for that power and arrange for the necessary transfer of delivery. Purchasers of that power must observe whatever restrictions are placed on the use of that power. The money received by the Commission from the sale of that power to others will be credited to the contractor, except that the Commission will collect no more than the contractor’s cost of the power. The failure by the Commission in whole or in part to make such an arrangement does not relieve the contractor of its obligation to pay the Commission for the full amount of the power for which it contracted, whether the power is delivered to the contractor or to others.
